Loligo Systems products and/or software not intended for use in life support or mission-critical systems, or in clinical or diagnostic applications. Use of any of our products in such applications is not supported by Loligo Systems.
Use of any Loligo Systems product is at the user\'s sole risk and discretion. In no event shall Loligo Systems be liable for any damages of any kind, incidental or consequential, regardless of the legal theory applied, caused directly or indirectly by our products or their instructions or associated components and materials.
Limitation of Remedies:
Loligo Systems shall not be liable under any circumstances for any special, consequential, incidental, punitive or exemplary damages arising out of or in any way connected with this agreement to sell goods to buyer of the goods, including, but not limited to, damages for lost profits, loss of use, lost data, or for any damages or sums paid by buyer to third parties, even if Sable Systems has been advised of the possibility of such damages. The foregoing limitation of liability shall apply whether the claim is based upon principles of contract, warranty, negligence, or other tort, breach of any statutory duty, principles of indemnity or contribution, the failure of any limited or exclusive remedy to achieve its essential purpose, or otherwise.
